If you do not see that you are able to take the yout opponent's king until you are actually making a move yourself, therefore not saying Check, do you still win the game? The move was an accident and totally unexpected by the person winning the game.

Klleg2 -- No, upon noticing your opponent is in check, you must tell your opponent to take back his/her move (since a move that doesn't remove check is illegal) and to make a move that removes check. Of course, if there is no such move, it's checkmate and you've won.
